Warranty on trolleys

Lifetime warranty

Helge Nyberg AB’s lifetime warranty on trolleys and scooters is applicable on all trolleys and scooters in Helge Nyberg AB’s standard range. This warranty does not apply to ESD-trolleys (see below), custom made trolleys, trolleys and scooters outside of Helge Nyberg AB’s standard range or electrical driven trolleys. 

In accordance with the provisions in this warranty and if Helge Nyberg AB exists, Helge Nyberg AB shall remedy any defect in the goods resulting from faulty design, materials, or workmanship.

Under this warranty Helge Nyberg AB shall, at its own expense by replacing or repairing the faulty goods remedy or insufficiency. However, the buyer shall bear the increase in costs of remedying a defect which Helge Nyberg AB incurs when the goods are located elsewhere than at the destination stated in the contract or – if no destination has been stated – the place of delivery.

Helge Nyberg AB’s liability under this warranty does not cover defects caused by usage noncompliant to Helge Nyberg AB’s instructions. Nor does it cover defects due to faulty maintenance or incorrect installation from the buyer’s side, alternations undertaken without Helge Nyberg AB’s written consent or faulty repairs by the buyer. Finally, the liability does not cover normal wear and tear or

deterioration.

The warranty described above is exhaustive and Helge Nyberg AB has no liability other than what is stated above.

This warranty is applicable on trolleys and scooters invoiced on or after the 1st of august 1997.

ESD-trolleys 5-year warranty

The warranty on ESD-trolleys is the same as for trolleys in Helge Nyberg AB’s regular range of trolleys except for the following.

The time of warranty is limited to five (5) years from dispatch date from supplier. Trolleys are approved by Rise Research Institutes of Sweden, and they fulfil the requirements according to SP-method 2472.

Trolleys leading ability is guaranteed only to the extent the specifications and advice are followed.

Electric driven products 1 year warranty

The warranty on electric driven products is the same as for trolleys in Helge Nyberg AB’s standard range except for the following. The time of warranty is limited to one (1) year from dispatch date from Supplier.

Spare parts and Replaced Parts

The warranty on spare parts and replaced parts for the standard range of products is the same as the above except for the time of warranty is limited to ten (10) years from dispatch date from Supplier. For all other products the warranty period for spare parts and replaced parts is one (1) year.

Sales conditions

Delivery

The products are delivered Ex Works (EXW) Ulricehamn, or when agreed, Ex Works from another of Helge Nyberg’s storages in Europe, when the buyer wishes to use his own freight agreements/details. These must then be sent to

Helge Nyberg in reasonable time before delivery. 

The products are delivered Carriage Paid To (CPT) Ulricehamn, or when agreed, CPT from another of Helge Nyberg’s storages in Europe, when the buyer wishes to use Helge Nyberg’s freight agreement. The freight and other transport costs will then be added to the buyer’s invoice from Helge Nyberg.

Normal packaging

Helge Nyberg AB’s prices include normal packaging. Special packaging and pallets will be invoiced separately after agreement.

Damages in transportation

The goods are sent on the buyer’s risk. The buyer shall report damages immediately to the carrier and claim indemnification. Return of goods will not be accepted unless Helge Nyberg AB has given its consent.

Price

Price will be separately agreed. Prices are exclusive of freight and VAT when applicable.

Terms of payment

Unless otherwise agreed, the terms of payment are 30 days net from date of invoice. If the buyer fails to pay by the due date, Helge Nyberg AB shall be entitled to interest from the due date. The interest shall be the Swedish reference rate with an addition of nine (9) percentage points.

Recycling

Helge Nyberg AB recommends the buyer to use a local recycling station. However, the product may also be sent to Helge Nyberg AB for recycling on the buyer’s expense.

Reservation

In exceptional cases, such as the product, raw material and major currency changes, we can be forced to make some price changes. The price stated on the order confirmation, is the existing price.Prices can be adjusted.Items are owned by Helge Nyberg AB until they are paid.Variations in color may occur due to technical reasons.Helge Nyberg AB reserves the right to product and design changes.

Helge Nyberg AB reserves:

• The events beyond our company's control (wars, earthquakes, floods, etc.), so-called force majeure.
• That a product can run out or be deleted from the range. We can in these cases usually offer a replacement product.
• Typographical errors.
